Perennially controversial, education and the issues relating to it can present any number of difficulties for the practitioner charged with advising on these matters or providing representation in court. Fortunately help is at hand in this definitive work of reference from Jordans.
Now in a new third edition containing much new material, `Education and the Courts' has established itself as an authoritative and valuable work of reference, focusing as it does on the approach taken by the courts to education litigation in England and Wales. Written by an acknowledged expert in this area, the volume will certainly lend the practitioner, experienced or inexperienced, even further authority in court.
In view of a number of significant new developments in education that have emerged since the former second edition of this work in 2003, the publication of this new edition is certainly timely. As author Richard McManus reminds us, the Law of School Transport has a new statutory framework, including the right to litigate pure transport issues in the First-tier Tribunal on behalf of those with statements of special educational needs. Noteworthy here is that the role of the courts has been much reduced following the introduction of the right of appeal to the Upper Tribunal.
There have been other developments carefully examined in this book. For example, Chapter 3 on `Discrimination' deals, among a host of other matters, with disputes about school uniforms and dress codes, particularly religious dress, as in the case of (Begum) v Denbigh High School in the House of Lords in which it was held that the school's uniform policy was justified.
Pertinent to this and other matters throughout, is the detailed examination of the impact of the Human Rights Act 1998. Also in the field of school organisation, the last decade has seen the proliferation of Academies, although as the author points out the problems created by single sex schools and equality still have not been resolved.
These issues, together with the full range of education related disputes are covered succinctly, yet in detail, including for example, school admissions... school discipline and exclusions... and private law actions in damages -- as well as university students and independent schools.
Whether you regularly practice in this field, or much of it is new to you, this book will certainly appeal. Note that there are ample resources for further research, with extensive footnoting and all the relevant tables of cases, statutes, statutory instruments, EU Materials and Codes of Practice, plus as the useful index at the back.
